Arizona appeals court upholds regulatory commission's authority over railroad improvements

The state appellate court has upheld a decision that allowed train engineers to silence their horns in Flagstaff.
The court ruled Tuesday that the Arizona Corporation Commission was not pre-empted by federal law from approving the installation of wayside horns at two railroad crossings as part of a quiet zone.
Burlington Northern Santa Fe had challenged the authority of the commission in Maricopa County Superior Court, saying the federal Train Horn Rule did not allow the commission to consider the matter. Continued
